Section 1: Introduction & Binding Agreement

By accessing or using the QuantumOne website, mobile application (iOS and Android), correlation engine, advice engine, 3D hologram dashboard, or any related features, content, and services (collectively, the "Services"), you explicitly acknowledge and agree to this Medical Disclaimer in full.

QuantumOne is designed for and directed at users physically located in the United States. We make no representation that the Services comply with the laws of any other jurisdiction. If you access the Services from outside the United States, you do so at your own risk and are solely responsible for compliance with your local laws.

This Disclaimer is a binding legal agreement between you and QuantumOne (the "Company"). It applies to all current and future features, including the correlation engine and any self-experiment tracking.

By using the Services, you also consent to the collection, processing, and analysis of your health, biometric, genetic, and lifestyle data — including through the correlation engine — as described in our Privacy Policy. This data processing is essential to the functioning of the Services.

For users of the mobile app, acceptance occurs when you check the box confirming you have read and agree to this Disclaimer during account registration. For website visitors, continued use of the website after being presented with this Disclaimer constitutes acceptance. By creating an account, you represent and warrant that you are at least eighteen (18) years of age. If you are under eighteen, you may not use the Services.

Section 2: Informational & Educational Purposes Only (General Wellness Only)

All content, data visualizations, correlations, advice, responses, and recommendations provided through the Services are solely for general wellness, self-optimization, performance tracking, and Kaizen-style incremental improvement.

The Services are offered as a general wellness and self-optimization tool. The Services are intended to fall within the scope of the FDA's General Wellness Policy as a product that promotes general wellness through lifestyle and activity management. However, the FDA has not independently reviewed, verified, classified, or endorsed QuantumOne or any of its features under this or any other regulatory framework. If the FDA or any other regulatory body determines that any feature of the Services constitutes a medical device or requires regulatory clearance, we will modify or discontinue the affected feature as necessary. They are not intended to diagnose, cure, mitigate, treat, or prevent any disease or medical condition.

We make no disease-specific claims. Any reference to health markers, genetics, supplements, or lifestyle factors is for informational and optimization purposes only.

QuantumOne does not recommend, endorse, or guarantee any specific supplement, nootropic, peptide, biohack, wearable device, genetic testing provider, blood testing laboratory, medical test, healthcare provider, product, brand, or procedure that may be referenced, displayed, or suggested within the Services.

Any reference to a third-party product, service, or provider is for informational and integration purposes only and does not constitute an endorsement or recommendation of that product, service, or provider.

Section 3: Not a Medical Device / Not Software as a Medical Device (SaMD)

QuantumOne is explicitly not a medical device and is not Software as a Medical Device (SaMD) as defined by the FDA.

The Services have not been reviewed, cleared, or approved by the FDA or any other regulatory body for any medical purpose.

The correlation engine and all outputs are not intended for use in the diagnosis, treatment, or prevention of disease.

Section 4: Not Medical Advice, Diagnosis, Treatment, or Cure

The Services do NOT constitute medical advice, a medical opinion, diagnosis, prognosis, treatment plan, or recommendation to treat, cure, mitigate, or prevent any disease, disorder, or medical condition.

The correlation engine and all advice are NOT a substitute for professional medical care and are not the practice of medicine; even when they use medical terminology or appear highly personalized, specific, or quantified.

Never delay, ignore, or avoid professional medical advice because of anything you read or are advised in the app.

If any information you receive from the Services is inconsistent with the medical advice of your physician or other qualified healthcare provider, you should follow the advice of your physician or healthcare provider. In all cases, the judgment of a licensed healthcare professional takes precedence over any output of the Services.

The Services do not provide a "second opinion" to your physician's advice, nor should any output from the Services be used to question, contradict, override, or delay following the recommendations of your licensed healthcare provider.

You must not use the Services as your sole source of health information or guidance, and you must not make significant health decisions based solely on information provided by the Services without independent verification by a qualified healthcare provider.

The Services do not replace routine medical care, screenings, or physician visits.

By using the Services, you represent to us — and this representation is deemed to be made each time you use the Services — that you are not using the Services for the purpose of seeking medical attention, obtaining a medical diagnosis, or as a substitute for the advice or treatment of a licensed healthcare provider. If you are being treated for any illness, taking prescription medication, or following a therapeutic diet prescribed by your physician, you are strongly urged to consult with your physician before using the Services.

The genetic analysis provided by the Services is consumer-grade interpretation of user-uploaded data — it is not clinical-grade genetic testing. Many of the genetic associations referenced by the Services have not been clinically validated for diagnostic use. The Services are not intended to tell you about your current state of health, diagnose a genetic condition, or determine whether you carry a clinically significant genetic variant. If the Services identify a genetic finding that concerns you, you should seek confirmatory clinical-grade genetic testing through a qualified healthcare provider or CLIA-certified laboratory before taking any action.

If the Services surface a finding that you consider significant — particularly regarding genetics, blood markers, or health trends — we strongly advise you to confirm that finding through independent, clinically validated testing conducted by a licensed healthcare provider before making any health, lifestyle, or reproductive decisions based on it.

You agree that no output from the Services — including correlations, advice, trend analyses, or any other data, report, or recommendation — shall be used in any legal dispute, litigation, arbitration, insurance claim, disability benefits claim, workers' compensation claim, malpractice claim, or any other legal or administrative proceeding against any third party, without the prior written consent of QuantumOne. QuantumOne outputs are not validated for forensic, legal, or evidentiary purposes and should not be relied upon as evidence of any medical condition, health status, or causal relationship.

Section 5: No Doctor-Patient or Healthcare Provider Relationship

Use of the Services does NOT create any doctor-patient relationship, physician-patient relationship, or any other licensed healthcare provider relationship with QuantumOne, its founders, employees, contractors, advice engine, or advisors.

QuantumOne is a technology company. We are not a laboratory, medical provider, healthcare facility, or clinical service. All clinical data displayed within the Services originates from third-party laboratories, testing providers, wearable devices, and user-uploaded reports. QuantumOne does not perform any clinical tests, laboratory analyses, or medical examinations.

We are not licensed physicians, dietitians, pharmacists, or any other regulated healthcare professionals.

QuantumOne is not a covered entity under HIPAA and does not comply with HIPAA requirements.

This means that the health data you provide to QuantumOne is not protected by HIPAA's privacy and security rules. Your data is instead governed by our Privacy Policy and applicable state privacy laws, including the California Consumer Privacy Act (CCPA) where applicable.

To provide the Services, including longitudinal correlations and trend analysis, QuantumOne retains your uploaded data, connected device data, and manually entered data for the duration of your active account. If you request deletion of your account or data, we will process that request in accordance with our Privacy Policy and applicable law. However, you should be aware that insights, correlations, or advice previously generated from your data may have already been delivered to you and cannot be retroactively rescinded, and de-identified or aggregated data derived from your inputs may be retained as described in our Privacy Policy.

While QuantumOne implements technical and organizational security measures as described in our Privacy Policy, no method of electronic storage or transmission is completely secure. In the event of a data breach or unauthorized access to your data, QuantumOne's liability is limited as set forth in Section 16 of this Disclaimer. You acknowledge and accept the inherent risks of transmitting and storing personal health, biometric, and genetic data electronically. We strongly recommend that you consider these risks before uploading sensitive health information, particularly genetic data, which as noted in Section 7 is permanent and cannot be changed if compromised.

Section 6: Algorithmic and Correlation Limitations (Core Product Feature)

Advice is generated by an automated correlation engine that analyzes user data against academic literature and statistical patterns.

The correlation engine itself has not undergone clinical validation, peer-reviewed studies, or any regulatory clearance.

Correlations do NOT equal causation. Statistical associations identified by the engine are NOT proof that one factor causes another.

Any quantified "expected impact" is a statistical estimate derived from population-level correlations and literature only; it is not a prediction or guarantee of results for you. Individual results will vary and may be zero or negative.

The engine may produce inaccurate, incomplete, or misleading outputs due to data quality issues, missing variables, limitations in research, model errors, or changes in scientific understanding.

Insights, advice, predictive analytics, trend analysis, and any experimental or beta features within the Services are provided on a non-diagnostic basis and are intended solely for educational, informational, and self-optimization purposes. These features do not replace clinical testing, professional medical judgment, or the advice of qualified healthcare providers. Advice may not be suitable for all individuals due to differences in health status, medical history, medications, age, or other personal factors. The accuracy and applicability of advice has not been clinically validated and should be considered in consultation with your healthcare provider before acting any such advice.

The Services do not monitor for medical emergencies, critical lab values, or dangerous health conditions in real time or otherwise. The Services will not alert you if a data point — including but not limited to blood test values, heart rate, blood glucose, or any other biomarker — reaches a level that may require urgent medical attention. You should not rely on the Services to detect or warn you of any medical emergency or clinically dangerous condition. If you believe you are experiencing a medical emergency, call 911 immediately.

All advice, correlations, and recommendations generated by the Services are based on the scientific literature and data available at the time they are generated. Scientific understanding evolves continuously. Findings that are considered valid today may be revised, contradicted, or superseded by future research.

The Services do not guarantee that all outputs reflect the most current science, nor do they update previously generated advice in real time as new research emerges.

Correlation Engine: All advice, correlations, quantified impact estimates, and any outputs from the correlation engine are generated by automated statistical models that have not undergone clinical validation, peer review, or regulatory clearance. These outputs reflect population-level associations and literature only; they are not personalized medical predictions and may be inaccurate, incomplete, or change as science evolves. You must never rely on them as a substitute for professional medical judgment.

You should not assume that advice received at any point in time remains current or accurate indefinitely.

Section 7: Clinical Data Interpretation (Genetics, Blood Tests, DEXA, Pathology)

QuantumOne parses, extracts, and displays data from user-uploaded clinical reports (including DEXA scans, blood tests, pathology results, and genetic files) using automated text extraction and data processing technologies. This automated parsing is not clinical interpretation, medical review, or diagnosis. No licensed healthcare professional at QuantumOne reviews, validates, or interprets your individual clinical results. The parsed data is displayed for your informational and self-optimization purposes only. Any further review, interpretation, or clinical decision-making based on these results is solely between you and your qualified healthcare provider.

We do not verify, interpret, or clinically validate any user-uploaded clinical data (genetic files, blood test PDFs, DEXA scans, pathology reports, etc).

Interpretation of genetics, blood markers, DEXA results, or any pathology data is for general wellness and self-optimization purposes only and does not constitute clinical interpretation or medical advice.

Genetic data interpretation is probabilistic and does NOT predict disease risk or guarantee any health outcome.

Most genetic reports explain only a small portion of the heritability of any given trait. They do not account for gene-gene interactions (epistasis), epigenetic modifications, or the combined influence of environmental, dietary, microbial, medical history, and lifestyle factors; any or all of which may significantly affect your actual outcomes. A single genetic variant rarely tells the full story.

QuantumOne's genetic insights should be considered one data point among many, not a definitive assessment of risk or potential.

Genetic variant classifications are not permanent. The scientific community regularly reclassifies genetic variants as new evidence emerges — a variant classified as 'benign' or 'likely benign' today may be reclassified as 'pathogenic' or 'likely pathogenic' in the future, and vice versa. QuantumOne displays genetic information based on classifications available at the time of analysis and does not guarantee that it will automatically update previously generated interpretations when reclassifications occur. You should not make irreversible health, lifestyle, or reproductive decisions based solely on a single genetic variant classification without confirming the current classification with a qualified healthcare provider or licensed genetic counselor.

Variants of Uncertain Significance (VUS). Some genetic variants identified in your uploaded data may be classified as "Variants of Uncertain Significance" (VUS). A VUS is a genetic change for which there is currently insufficient scientific evidence to determine whether it is associated with increased disease risk or is benign. A VUS is not a positive result and should not be used to make health, lifestyle, or reproductive decisions. The classification of a VUS may change over time as new scientific evidence emerges — it may be reclassified as either benign (harmless) or pathogenic (disease-associated). QuantumOne displays genetic information based on the classifications available at the time of analysis and does not guarantee that it will automatically update previously generated interpretations when VUS reclassifications occur. If a VUS finding is surfaced through the Services, we strongly recommend that you consult a qualified healthcare provider or licensed genetic counselor before taking any action based on that finding. The majority of genetic research to date has been conducted on populations of European descent. As a result, genetic risk assessments, variant classifications, and population-level correlations may be less accurate, less relevant, or not applicable for individuals of non-European ancestry. Your ethnicity, ancestry, environmental exposures, and lifestyle factors may significantly affect the relevance and accuracy of any genetic insights provided by the Services. QuantumOne does not adjust for all ancestry-related limitations and makes no representation that genetic insights are equally accurate across all populations.

QuantumOne accepts raw genetic data files from third-party genetic testing providers (such as 23andMe, AncestryDNA, MyHeritage, and others). QuantumOne does not control, verify, or guarantee the accuracy, completeness, or quality of genetic tests performed by these or any other laboratories. By uploading genetic data from a third-party provider, you acknowledge that errors in the source data may lead to incorrect or incomplete interpretation. References to third-party genetic testing providers are for informational purposes only. QuantumOne does not endorse, recommend, or compare itself to any particular genetic testing company, and does not provide services under their trademarks.

Federal law, including the Genetic Information Nondiscrimination Act (GINA), provides certain protections against genetic discrimination by health insurers and employers. However, GINA does not extend to life insurance, long-term care insurance, or disability insurance. State laws may provide additional protections that vary by jurisdiction.

Unlike other personal data, your genetic information is permanent and immutable — it cannot be changed, reset, or replaced. A breach or unauthorized disclosure of genetic data cannot be remedied in the same way as a compromised password or financial account. By uploading genetic data to QuantumOne, you acknowledge this inherent and irreversible risk. While we implement security measures as described in our Privacy Policy, no system can guarantee absolute security, and you accept this risk as a condition of using genetic features of the Services.

By uploading genetic data to QuantumOne, you should be aware that while we protect your data as described in our Privacy Policy, the legal landscape surrounding genetic discrimination protections is incomplete. We strongly encourage you to understand your rights under federal and state law before uploading genetic information.

Section 8: Dispute Resolution, Arbitration & Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to this Disclaimer or the Services shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may bring individual claims in small claims court if they qualify.

You and QuantumOne each waive the right to a jury trial. You and QuantumOne each waive the right to participate in a class action, collective action, private attorney general action, or any other representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

Right to Opt Out of Arbitration. You may opt out of this arbitration agreement by sending written notice to legal@quantumone.app within thirty (30) days of first accepting this Disclaimer. Your notice must include your name, the email address associated with your account, and a clear statement that you wish to opt out of the arbitration agreement. If you timely opt out, you retain your right to bring claims in court, subject to the other provisions of this Disclaimer. If you do not opt out within thirty (30) days, you are deemed to have agreed to this arbitration provision.

This arbitration agreement survives termination of your account or the Services. If any part of this class action waiver is found to be unenforceable, the entirety of this arbitration section shall be null and void.

Nothing in this arbitration agreement waives any applicable sovereign immunity.

Section 9: Data Accuracy & User-Provided Information Limitations

We do not verify the accuracy, completeness, or reliability of any user-uploaded data or third-party data sources (wearables, Apple Health, Oura, Garmin, environmental data from TROPOMI Sentinel-5, EPA water quality portals, weather APIs, etc).

Wearable devices, third-party apps, and public environmental datasets have known accuracy limitations and can produce erroneous readings.

Clinical measurements such as DEXA scan results, blood test values, and pathology markers can vary significantly between testing facilities, laboratories, equipment manufacturers, calibration settings, and testing methodologies. Two tests of the same type performed at different facilities or on different equipment may produce materially different results even if your underlying health status has not changed. QuantumOne does not control, verify, or account for inter-facility or inter-laboratory variability when displaying or correlating your data. When comparing results over time, you should be aware that inconsistencies may reflect differences in testing conditions rather than true physiological changes. Consult your healthcare provider for guidance on interpreting changes in clinical measurements.

Bone density values displayed within the Services — whether parsed from uploaded DEXA scans or derived from connected devices — are presented for general wellness and tracking purposes only. They do not constitute a diagnostic bone density examination, an osteoporosis diagnosis, or a clinical assessment of fracture risk.

In particular, whole-body composition DEXA scans — which are the type most commonly uploaded by users — measure different skeletal sites and use different protocols than the site-specific diagnostic DEXA scans (hip, spine, and forearm) used by clinicians to diagnose osteoporosis, and may significantly underestimate fracture risk compared to a diagnostic scan.

Diagnostic bone density testing requires specific clinical protocols, site-specific measurements, and interpretation by a qualified healthcare provider. If your data suggests concerns about bone health, consult your physician for a proper diagnostic evaluation.

Reference ranges displayed alongside blood test values, biomarkers, and other clinical measurements are based on population averages and may not be appropriate for your individual circumstances. Factors including age, sex, ethnicity, medications, time of collection, hydration status, fasting state, recent exercise, and other variables can significantly affect whether a given value is clinically meaningful for you. A value displayed as 'out of range' or flagged by the Services does not necessarily indicate a medical problem, just as a value within the reference range does not guarantee normal health. Only a qualified healthcare provider can determine the clinical significance of your individual test results in the context of your complete medical history.

Genetic data files uploaded from third-party providers (such as 23andMe, AncestryDNA, or whole genome sequencing services) vary significantly in the type, depth, and accuracy of genetic information they contain. Different testing technologies (genotyping arrays, whole exome sequencing, whole genome sequencing) cover different portions of the genome at different levels of accuracy. QuantumOne does not validate the technical completeness or accuracy of uploaded genetic files, cannot detect genotyping errors in source data, and may not have access to all clinically relevant variants depending on the testing technology used by the original provider. Absence of a variant in your uploaded data does not mean you do not carry that variant — it may simply mean the original test did not assess it.

You are solely responsible for the accuracy of all data you enter or connect.

Because the correlation engine and advice engine generate outputs based on the data you provide and connect, inaccurate, incomplete, or erroneous input data — whether from user entry, wearable devices, third-party apps, or uploaded reports — may result in inaccurate, misleading, or inappropriate advice. QuantumOne is not liable for any advice, correlation, or recommendation that is rendered inaccurate by underlying data quality issues, regardless of the source of the inaccuracy.

Prescription medications, over-the-counter drugs, and other therapeutic interventions can significantly affect blood test values, biomarkers, sleep metrics, heart rate variability, and other data points tracked by the Services. The correlation engine does not automatically account for the confounding effects of medications on your data unless you have manually logged them. Correlations and advice generated without complete medication information may be inaccurate or misleading. You are responsible for ensuring that your healthcare provider is aware of all medications you are taking when interpreting any insights from the Services, and for understanding that medication effects may explain changes in your tracked biomarkers.

Environmental data (air quality, UV index, pollen, solar radiation, water quality, weather, mold risk, and atmospheric conditions) are derived from publicly available datasets and represents regional estimates, not measurements taken at your specific location. Actual conditions at your location may differ materially from the data displayed.

All advice, recommendations, and suggestions are generated with reference to supplements, products, and practices available and legal in the United States. QuantumOne makes no representation regarding the legality, availability, or appropriateness of any recommendation outside the United States.

The Services do not screen for food allergies, intolerances, dietary restrictions, or religious dietary requirements. You are solely responsible for ensuring that any dietary recommendation is safe and appropriate for your individual circumstances, including but not limited to allergies, intolerances, and medical dietary restrictions.

The Services may include or integrate a food and nutrition database containing nutritional information sourced from government databases (such as the USDA), third-party data providers, food manufacturers, and user-contributed entries. QuantumOne does not independently verify the accuracy, completeness, or currentness of all nutritional information in the database. Nutritional values may be inaccurate due to data entry errors, regional labeling differences, product reformulations, variation in preparation methods, or other factors. User-contributed nutritional data has not been reviewed or verified by QuantumOne or by any nutrition professional. You should not rely solely on nutritional information provided by the Services for managing medical dietary requirements, food allergies, drug-nutrient interactions, or any condition where precise nutritional information is critical. QuantumOne expressly disclaims all responsibility for food safety decisions, allergen avoidance, and medication contraindications based on nutritional data displayed in the Services.

The Services may provide insights, correlations, or suggestions related to physical activity, exercise intensity, exercise timing, or training modifications. Before beginning, modifying, or intensifying any exercise program based on information from the Services, consult your physician — particularly if you have been sedentary, have a history of cardiovascular disease, musculoskeletal injury, or any other condition that may be affected by physical exertion. QuantumOne is not responsible for any injury, illness, or adverse outcome resulting from exercise or physical activity undertaken based on information provided by the Services.

The Services may reference or provide information about peptides, research compounds, SARMs, designer nootropics, or other substances that are available by prescription only, that occupy a legal gray area, or whose regulatory status varies by jurisdiction or may change over time. This includes compounds often sold for 'research purposes only' with explicit disclaimers against human consumption. QuantumOne does not verify purity, safety, sourcing, or legal status of any such substances. You assume all risks associated with acquisition, possession, and use.

QuantumOne does not verify the legal status of any substance in your state or jurisdiction, does not encourage the acquisition or use of any prescription substance without a valid prescription, and makes no representation that any referenced substance is legal to purchase, possess, or use without medical supervision.

You are solely responsible for determining the legality of any substance in your jurisdiction and for obtaining appropriate medical oversight before using any prescription or gray-area compound. QuantumOne is not responsible for any legal consequences arising from your decision to acquire or use any substance referenced in the Services.

Section 10: Supplement, Nootropic, Biohack & Lifestyle Change Risks

Recommendations involving supplements, nootropics, biohacks, dosing changes, dietary shifts (e.g., low-carb, intermittent fasting), exercise, sleep adjustments, behavior changes, or environmental modifications carry inherent risks (interactions, overdose, side effects, allergic reactions, nutrient imbalances, injury, over-training, unknown long-term effects).

The statements made within the Services regarding dietary supplements, nootropics, and other non-pharmaceutical products have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease.

Always consult your physician before beginning any supplement regimen.

Any dosage information, dosing schedules, or supplement quantity suggestions provided by the Services are for informational reference only and are not personalized medical prescriptions. Appropriate dosages vary significantly based on individual factors including body weight, age, sex, genetics, existing health conditions, medications, and other supplements being taken concurrently. A dosage that is safe or effective for one person may be ineffective, excessive, or dangerous for another. Nootropics and cognitive enhancers may interact dangerously with prescription medications and are not FDA-evaluated for the specific uses suggested.

Self-experimentation (Experiments tab) is entirely at your own risk; changing multiple variables simultaneously creates n=1 trials that can make it impossible to isolate effects and may cause harm.

Older adults (65+): Age-related changes in metabolism, medication sensitivity, organ function, and disease risk may make certain recommendations inappropriate. Consult your physician before acting on any advice, particularly regarding supplements, exercise intensity, fasting, or dietary changes.

Section 11: Risk of Distressing Health Information

By using the Services, you acknowledge and accept the risk that you may discover information about your health, genetics, biomarkers, or health trends that is unexpected, unwelcome, or emotionally distressing. This includes, but is not limited to:

The Services do not filter, suppress, or withhold health findings based on their emotional impact. If data is available and relevant, it will be surfaced. QuantumOne does not assess your psychological readiness to receive any particular finding.

Before using the Services, you should consult with your physician or other qualified healthcare provider, particularly if you have any pre-existing medical condition, are taking prescription medications, or have concerns about your health. The Services are not a substitute for professional medical care and should be used only as a complement to — never a replacement for — the guidance of licensed healthcare professionals.

If you are not prepared to receive potentially distressing health information — particularly regarding genetic disease risk, declining biomarkers, or adverse correlations — you should carefully consider whether to use the genetic, blood test, clinical data, or correlation features of the Services.

If any finding generated by the Services causes you significant distress, we strongly encourage you to consult a qualified healthcare provider, licensed genetic counselor, or mental health professional. The Services are not a substitute for professional support in processing health-related information.

Section 12: Special Populations & Edge Cases

Pregnancy, breastfeeding, or attempting to conceive: Do NOT follow any advice without explicit clearance from your obstetrician.

Children or adolescents under 18: The Services are NOT intended for use by anyone under 18 and are strictly prohibited for this group.

Pre-existing medical conditions (cancer, cardiovascular disease, autoimmune disorders, mental health conditions, epilepsy, kidney/liver disease, etc.): Consult your physician before any change.

Mental health conditions: The Services may track, correlate, or provide suggestions related to mood, cognitive performance, stress, energy levels, or other metrics that overlap with mental health. These features are for general wellness and self-optimization purposes only and are not intended to screen for, diagnose, monitor, or treat any psychiatric or mental health condition — including but not limited to depression, anxiety disorders, bipolar disorder, ADHD, PTSD, or any other condition listed in the DSM-5 or ICD. If you are currently being treated for a mental health condition, are taking psychiatric medications, or believe you may be experiencing symptoms of a mental health condition, consult a licensed mental health professional before acting on any mood-related, cognition-related, or stress-related insight from the Services. The Services are not a crisis intervention tool. If you are in crisis or experiencing suicidal thoughts, contact the 988 Suicide and Crisis Lifeline (call or text 988) or go to your nearest emergency room immediately.

Eating disorders and disordered eating: If you have been diagnosed with, are recovering from, or believe you may be at risk of developing an eating disorder — including but not limited to anorexia nervosa, bulimia nervosa, binge eating disorder, orthorexia, or any other disordered eating pattern — you should not use the Services without the prior approval and ongoing supervision of a qualified healthcare provider or licensed mental health professional experienced in eating disorder treatment. The Services include features such as nutrition tracking, dietary correlations, calorie and macronutrient data, body composition metrics, and optimization-oriented advice that may be inappropriate, triggering, or harmful for individuals with a current or past eating disorder. Any use of the Services to promote, achieve, or maintain dangerously low levels of eating, or to facilitate restrictive, purging, or other disordered eating behaviors, is expressly prohibited. QuantumOne is not designed to detect, screen for, or prevent eating disorders, and the absence of a warning from the Services does not indicate that your eating patterns are healthy or safe. If you believe your use of the Services is contributing to an unhealthy relationship with food, body image, or exercise, discontinue use immediately and seek professional help.

Risk of distressing health information: Use of the Services may result in the discovery of health information that is unexpected or distressing. See Section 11 for important details and warnings.

Emergency situations: Immediately seek emergency medical care. Do NOT rely on the app.

Section 13: Assumption of Risk & User Responsibility

You assume ALL risk of injury, harm, side effects, or adverse outcomes resulting from following (or ignoring) any advice, correlation, or recommendation provided by the Services.

You are solely responsible for all decisions regarding your health, supplements, biohacks, lifestyle, and medical care.

To the fullest extent permitted by applicable law, you release QuantumOne from all claims, known and unknown, that arise from or relate to your use of the Services. You acknowledge that you may later discover facts different from or in addition to those you currently know or believe to be true regarding your use of the Services, and you agree that this release shall remain effective in all respects notwithstanding the discovery of such facts.

If you are a California resident, you hereby waive California Civil Code Section 1542, which states: 'A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.' You acknowledge that this waiver is an essential element of this Disclaimer.

You agree to indemnify, defend, and hold harmless QuantumOne, its officers, directors, employees, contractors, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Services, your data, or your actions based on the advice.

We may update this Disclaimer at any time.

We will display the 'last updated' date at the top and bottom of this document and will notify you of material changes by email and an in-app notice.

If we make material changes to this Disclaimer, we will notify you by (a) sending an email to the address associated with your account, and (b) displaying a prominent notice within the app or on our website. Material changes will take effect no sooner than thirty (30) days after we provide notice, unless the change is required by law or relates to a new feature or service, in which case the change may take effect immediately upon notice. Your continued use of the Services after the effective date of a material change constitutes your acceptance of the updated Disclaimer. If you do not agree with a material change, you must stop using the Services before the effective date.

Section 16: Disclaimer of Warranties & Limitation of Liability

The Services are provided "AS IS" and "AS AVAILABLE" with no warranties of any kind, express, implied, or statutory.

No advice, insight, correlation, recommendation, or other information provided through the Services, whether delivered through the advice engine, correlation engine, or any other feature, creates any warranty or guarantee not expressly stated in this Disclaimer.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. QUANTUMONE EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR TRADE USAGE. QUANTUMONE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY CONTENT, DATA, OR OUTPUT WILL BE ACCURATE, RELIABLE, OR COMPLETE. Some states do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In such states, our warranties are limited to the maximum extent permitted by law.

QuantumOne expressly disclaims all liability for any loss, injury, damage, or expense (including direct, indirect, consequential, punitive, or incidental) arising from your use of the Services.

Our maximum liability to you is capped at the amount you paid for the subscription in the preceding 12 months (or $100 if no payment has been made).

QuantumOne does not guarantee uninterrupted, timely, or error-free operation of the Services. The Services may be temporarily or permanently unavailable due to maintenance, technical failures, third-party service disruptions, internet connectivity issues, force majeure events, or other causes beyond our reasonable control. We are not liable for any harm, loss, or adverse outcome arising from service interruptions, delayed data processing, stale or missing data, or the temporary unavailability of any feature — including the correlation engine, advice engine, or data integrations. You should not rely on the continuous availability of the Services for time-sensitive health decisions.

We have no liability for third-party data sources, wearable manufacturers, or third-party service providers.

Section 17: Governing Law & Jurisdiction

This Disclaimer and all Services are governed exclusively by the laws of the State of Delaware, USA, without regard to conflict of laws principles.

Any dispute arising out of or relating to this Disclaimer or the Services shall be brought exclusively in the state or federal courts located in Wilmington, Delaware, and you consent to the personal jurisdiction and venue of such courts.

Any claim or cause of action arising out of or relating to your use of the Services or this Disclaimer must be filed within one (1) year after such claim or cause of action arose, regardless of any statute or law to the contrary. Any claim or cause of action not filed within this period is permanently barred.

The following sections shall survive any termination or expiration of your account or your use of the Services: Sections 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 16, 17, 18, 19, and 20, along with any other provisions that by their nature should survive termination.

Section 18: Severability & Entire Agreement

If any provision of this Disclaimer is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

This Disclaimer, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between you and QuantumOne regarding your use of the Services and supersedes all prior or contemporaneous agreements, communications, and proposals regarding the subject matter hereof.
